Welcome to Kirana Bakehouse. These Terms of Service ("Terms") govern your access to our website (kiranabakehouse.com) and participation in our monthly sourdough bread subscription service. By using the site or subscribing, you agree to be bound by these Terms.
1. The Subscription Service
We offer a monthly subscription that delivers 4 handcrafted, naturally leavened sourdough loaves (one per week) for $60 per month. Cancellations made after a billing date are not eligible for refund or credit for that month's delivery.
2. Payment and Billing
You authorize Kirana Bakehouse (or our payment processor) to charge your chosen payment method $60 each month. All charges are in U.S. dollars and non-refundable except where required by law. We may adjust pricing or availability with notice.
3. Delivery
Delivery is available only in Palo Alto, Menlo Park, and Atherton. Delivery dates and times are estimates. We are not responsible for delays, spoilage, theft, damage in transit, or issues resulting from incorrect delivery information provided by you or factors outside our control (weather, carrier issues, etc.).
4. Limitation of Liability
To the fullest extent permitted by law, Kirana Bakehouse, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, service, or products — even if advised of the possibility of such damages. Our total liability to you shall not exceed the total amount you paid us in the twelve (12) months preceding the claim.
5. Disclaimer of Warranties
The website and all products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
6. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our service shall be resolved exclusively in the state or federal courts located in Santa Clara or San Mateo County, California. You waive any right to a jury trial or to participate in a class action.
7. Changes to These Terms
We may revise these Terms at any time. The updated version will be posted here with a revised "Last updated" date. Your continued use of the service after changes constitutes acceptance of the revised Terms.
8. Right to Refuse or Terminate Service
We reserve the right, in our sole discretion, to refuse service, terminate or suspend any subscription or account, cancel orders, or remove access to our website or services at any time and for any reason, including but not limited to:
- Violation of these Terms of Service or any applicable policies
- Disruptive, abusive, harassing, or unsafe behavior toward our team, other customers, or our operations
- Non-payment, fraudulent activity, or repeated failed delivery attempts due to incorrect information
- Capacity limitations, operational constraints, or to maintain the quality and intentional small-batch nature of our service
- Any other legitimate business reason
Nothing in this section permits discrimination based on protected characteristics under applicable federal, state, or local law, including the California Unruh Civil Rights Act. We will make reasonable efforts to provide notice where appropriate, but we are not obligated to do so.
